These Terms govern your use of Spooky Portraits (spooky.gamalabs.ai), operated by Gustavo Mier (persona física), nombre comercial GamaLabs ("GamaLabs", "we"), Querétaro, Mexico. By ticking the consent box, uploading a photo or buying, you accept these Terms, our Privacy Notice and our Refund Policy. If you do not agree, do not use the service.
You must be at least 18 years old and legally able to enter into contracts. By using the service you declare that you are.
Upload only a photo of yourself, or of another adult who has given you their express consent. It is forbidden to upload: photos of third parties without consent; photos of minors (anyone under 18), even your own children; nudity or sexual content; public figures; content that is illegal, violent, hateful or that infringes someone's rights (privacy, image, copyright). You are solely responsible for what you upload and must indemnify GamaLabs for any claim arising from a breach of this section.
Every photo goes through automated moderation before generation; results also pass the AI provider's safety filters. We may reject photos or results, block devices/IPs, cancel orders and report to authorities content that appears illegal (especially involving minors), without liability. Automated moderation may make mistakes; if a photo is wrongly rejected, simply try another.
No deepfakes meant to deceive, harass, defame, impersonate or sexualize anyone; no use for fraud, identity documents or political disinformation; no attempts to bypass moderation, limits, payments or watermarks; no scraping, automated access or reverse engineering.
Portraits are artistic interpretations generated by artificial intelligence. We do not guarantee resemblance, accuracy, a specific style or quality, and results vary with the photo. Results may contain artefacts. The free preview lets you see the result before paying. Dissatisfaction with an artistic result is not a technical failure.
Prices are in U.S. dollars (USD) only: one style in HD USD $2.99; pack of all 6 styles in HD USD $6.99 (the struck-through "$17.94" equals 6 × $2.99 bought separately). Free previews: up to 2 per day per user/IP. Payments are processed by Stripe; your bank may apply exchange rates or foreign-transaction fees we do not control. Prices include any taxes we are required to charge unless stated otherwise. Each payment unlocks HD only for the selfie previewed when you paid.
HD portraits are digital content delivered immediately after payment is verified, and are available for re-download for 24 h. Download them promptly; after 24 h they are deleted and cannot be recovered. By paying you request immediate delivery and acknowledge that, once delivery begins, you lose any right of withdrawal (including the EU/UK 14-day right), as permitted by law. See the Refund Policy.
Please contact us before disputing a charge; most problems are solved quickly. If you file a chargeback for a purchase that was delivered, we will provide Stripe and your bank with evidence of delivery (session, timestamps, logs) and may block further use. Fraudulent chargebacks may be pursued.
You keep all rights to your photo. You grant us a limited, temporary, non-exclusive licence to process it solely to provide the service, which ends when it is deleted. Subject to payment and these Terms, GamaLabs assigns to you whatever rights it may have in your generated portraits and grants you a licence to use them for personal, non-commercial purposes (including posting on your social networks). Commercial use, resale or use in advertising requires our prior written permission. Copyright protection for AI-generated images may be limited by law. The app, brand, styles, prompts and code belong to GamaLabs. Please label portraits as AI-generated where platforms require it. We will not use your portraits for promotion without your express permission.
The service is provided "as is" and "as available". It may be paused (e.g., capacity or budget limits) or discontinued at any time; paid orders that cannot be delivered will be refunded.
To the maximum extent permitted by law, GamaLabs is not liable for indirect, incidental, consequential or punitive damages, loss of data, reputation or profits, or for the use you or third parties make of the portraits. Our total liability for any claim is limited to the amount you paid for the order in question. Nothing here limits rights that cannot be waived under applicable consumer law (including Mexico's Federal Consumer Protection Law).
You will indemnify GamaLabs against claims, damages and costs arising from your content, your breach of these Terms or your violation of third-party rights.
These Terms are governed by the federal laws of Mexico. Disputes will be submitted to the competent courts of Querétaro, Querétaro, Mexico, without prejudice to consumers' rights to go to PROFECO or to mandatory protections of their country of residence.
We may update these Terms; the version in force at the time of your purchase applies to it. Contact: privacy@apps.gamalabs.ai. In case of discrepancy, the Spanish version prevails for users in Mexico.
